Welcome to Check On Me.

These Terms and Conditions ("Terms") govern your access to and use of the Check On Me mobile application, website, and related services (collectively, the "Service") provided by Check On Me ("Check On Me," "we," "our," or "us").

By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree with these Terms, you should not use the Service.

Please read these Terms carefully before using Check On Me.

1. About Check On Me

Check On Me is a personal safety and check-in application designed to help individuals who live alone, older adults, individuals who may benefit from periodic check-ins, and other users who want an additional layer of safety and communication.

The Service allows users to create scheduled check-ins and designate trusted family members, friends, caregivers, or other contacts.

If a user fails to respond to a scheduled check-in within the configured period, the Service may send a notification to the user's designated contact asking that person to check on the user.

Check On Me is intended to provide an additional safety and communication tool. It is not an emergency response service, medical monitoring service, security service, or substitute for professional care or emergency services.

2. Eligibility

You must meet the minimum age requirement applicable in your country to create and use a Check On Me account.

If you are using Check On Me on behalf of another person, including an older adult, dependent, family member, or person requiring assistance, you represent that you have the appropriate authority or permission to do so.

You are responsible for ensuring that your use of the Service complies with applicable laws and regulations.

3. Creating an Account

Certain features of Check On Me require you to create an account.

When creating an account, you agree to provide accurate, current, and complete information.

You are responsible for:

  • Maintaining the accuracy of your account information.
  • Keeping your login credentials confidential.
  • Protecting access to your device and account.
  • Not sharing your password or authentication credentials with unauthorized individuals.
  • Promptly notifying us if you believe your account has been compromised.

You are responsible for activity conducted through your account unless the activity resulted from circumstances outside your reasonable control.

4. Check-In Functionality

The primary functionality of Check On Me is to allow users to establish scheduled check-ins.

A user may configure a check-in schedule, reminder, or timer through the application.

Depending on the user's settings, if the user does not respond to a check-in within the designated period, Check On Me may trigger a notification to one or more designated contacts.

Users are responsible for properly configuring their check-in settings and reviewing them periodically.

5. Designated Contacts

Users may add family members, friends, caregivers, or other trusted individuals as designated contacts.

You are responsible for ensuring that:

  • The contact information you provide is accurate.
  • You have an appropriate reason or authorization to provide another person's contact information.
  • The designated contact understands that they may receive Check On Me notifications.
  • You update or remove contacts when their information or relationship changes.

Adding someone as a contact does not guarantee that the person will receive or respond to a notification.

Where required, Check On Me may require a designated contact to independently consent to receiving SMS messages before notifications are sent to that contact.

6. SMS Notifications

Check On Me may use SMS, push notifications, email, or other communication methods to notify designated contacts.

SMS messages may be delivered through third-party telecommunications providers such as Twilio.

Message delivery depends on factors outside our control, including:

  • Mobile network availability.
  • Internet connectivity.
  • Carrier policies.
  • Device settings.
  • Phone number accuracy.
  • Phone battery or device status.
  • Carrier filtering.
  • Service outages.
  • Third-party provider availability.
  • Other technical limitations.

We do not guarantee that a notification will be delivered, delivered immediately, or received by the intended recipient.

Users and designated contacts are responsible for maintaining accurate contact information.

7. No Guarantee of Safety or Emergency Response

CHECK ON ME IS NOT AN EMERGENCY RESPONSE SERVICE.

The Service does not guarantee that an emergency will be detected, that a missed check-in accurately indicates an emergency, or that a designated contact will receive, read, understand, or respond to a notification.

A missed check-in may occur for many reasons, including:

  • The user intentionally did not respond.
  • The user forgot to respond.
  • The user was unable to use the application.
  • The user's device was turned off.
  • The user's device battery was depleted.
  • The device did not have an internet connection.
  • The application was not functioning correctly.
  • A notification was delayed or failed.
  • The user's phone number or contact information was incorrect.
  • A third-party telecommunications service experienced an outage.

Similarly, a user may respond to a check-in even when an emergency exists.

For any immediate, serious, or life-threatening emergency, users and designated contacts should contact the appropriate local emergency services or emergency responders directly.

Check On Me should not be used as the sole means of protecting a person who requires continuous medical, physical, or emergency supervision.

8. User Responsibility

You understand and agree that the effectiveness of Check On Me depends on your proper use of the Service.

You are responsible for:

  • Keeping the application installed and reasonably up to date.
  • Maintaining an active and functioning device.
  • Maintaining internet or cellular connectivity where required.
  • Keeping your phone sufficiently charged.
  • Providing accurate information.
  • Configuring appropriate check-in schedules.
  • Selecting appropriate designated contacts.
  • Keeping designated contact information current.
  • Informing designated contacts about their role.
  • Reviewing your notification and safety settings regularly.

9. Contact Information and Third-Party Data

When you provide information about another person, such as a family member, friend, caregiver, or emergency contact, you represent that you have a lawful basis or appropriate permission to provide that information.

You must not use Check On Me to collect or submit another person's personal information unlawfully.

You are responsible for providing accurate contact information.

10. Prohibited Uses

You agree not to use Check On Me:

  • For any unlawful purpose.
  • To violate the rights of another person.
  • To harass, threaten, intimidate, or abuse another person.
  • To knowingly provide false information.
  • To intentionally trigger false emergency or safety alerts.
  • To impersonate another person.
  • To use another person's personal information without appropriate authorization.
  • To interfere with the operation or security of the Service.
  • To attempt to gain unauthorized access to another account.
  • To reverse engineer, decompile, or attempt to extract source code from the Service except where expressly permitted by applicable law.
  • To introduce malware, viruses, or other harmful code.
  • To use automated systems to abuse or overload the Service.
  • To use the Service for purposes for which it was not designed.
  • To rely on the Service as a substitute for emergency services or professional medical care.

We reserve the right to suspend or terminate accounts involved in prohibited activity.

11. User Content

You may provide information to the Service, including names, contact information, profile information, check-in information, and other content.

You retain ownership of content that you submit to the Service to the extent that you have rights to that content.

By submitting information to Check On Me, you grant us the limited rights necessary to store, process, transmit, and use that information to provide and operate the Service.

We will handle personal information in accordance with our Privacy Policy.

You are responsible for ensuring that the content and information you submit does not violate applicable law or the rights of others.

12. Privacy

Your use of Check On Me is also subject to our Privacy Policy.

Our Privacy Policy explains how we collect, use, store, protect, and share personal information.

By using the Service, you acknowledge that you have reviewed the Privacy Policy.

13. Third-Party Services

Check On Me may rely on third-party services and technologies to provide certain functionality.

These services may include:

  • SMS and telecommunications providers.
  • Cloud hosting providers.
  • Authentication services.
  • Push notification services.
  • Analytics services.
  • Crash reporting services.
  • Payment providers, if applicable.

Third-party services may have their own terms and privacy policies.

We are not responsible for the availability, performance, policies, or actions of third-party services that we do not control.

14. Mobile Carrier Charges

Your mobile carrier may charge you for SMS, data, calls, or other communications associated with your use of Check On Me.

Check On Me does not control carrier fees or charges.

You are responsible for any charges imposed by your mobile carrier or telecommunications provider.

15. Intellectual Property

The Check On Me application, website, software, design, branding, logos, graphics, text, functionality, and other materials provided by Check On Me are owned by or licensed to Check On Me and are protected by applicable intellectual property laws.

Except as expressly permitted by these Terms, you may not:

  • Copy the Service.
  • Modify the Service.
  • Distribute the Service.
  • Sell or sublicense the Service.
  • Reproduce our branding or proprietary materials.
  • Create derivative works from the Service.
  • Attempt to obtain unauthorized access to the underlying software or systems.

Nothing in these Terms transfers ownership of Check On Me intellectual property to you.

16. Feedback

If you provide suggestions, ideas, recommendations, or feedback regarding Check On Me, you agree that we may use that feedback without restriction or compensation to you.

Providing feedback does not transfer ownership of your unrelated intellectual property to Check On Me.

17. Service Availability

We aim to provide a reliable service, but we do not guarantee that Check On Me will always be available or uninterrupted.

The Service may occasionally be unavailable because of:

  • Scheduled maintenance.
  • Emergency maintenance.
  • Software updates.
  • Server or infrastructure failures.
  • Internet outages.
  • Telecommunications outages.
  • Third-party service failures.
  • Cybersecurity incidents.
  • Events outside our reasonable control.

We may modify, suspend, or discontinue portions of the Service at any time.

18. Updates and Changes to the Service

We may update, modify, add, or remove features from Check On Me from time to time.

Some updates may be necessary to maintain compatibility, security, legal compliance, or functionality.

We do not guarantee that every feature will remain available indefinitely.

19. Payments and Subscriptions

If Check On Me introduces paid features, subscriptions, or other charges, the applicable pricing, billing terms, cancellation policies, and payment conditions will be presented to you before you make a purchase.

Payments may be processed through third-party payment providers or app store platforms.

Your use of paid features may also be subject to the terms of the applicable payment provider or app store.

20. No Medical Advice

Check On Me does not provide medical advice, diagnosis, treatment, or medical monitoring.

Information provided through the Service should not be interpreted as medical advice.

Users should consult qualified medical professionals for medical concerns.

If you believe you or another person is experiencing a medical emergency, contact the appropriate emergency services immediately.

21. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.

CHECK ON ME DOES NOT GUARANTEE THAT:

  • THE SERVICE WILL ALWAYS BE AVAILABLE.
  • CHECK-IN REMINDERS WILL ALWAYS BE DELIVERED.
  • SAFETY ALERTS WILL ALWAYS BE GENERATED.
  • SMS OR OTHER NOTIFICATIONS WILL ALWAYS BE DELIVERED.
  • A DESIGNATED CONTACT WILL RECEIVE OR RESPOND TO AN ALERT.
  • THE SERVICE WILL DETECT EVERY EMERGENCY.
  • THE INFORMATION PROVIDED BY THE SERVICE WILL ALWAYS BE ACCURATE OR COMPLETE.
  • THE SERVICE WILL BE FREE FROM ERRORS, INTERRUPTIONS, OR SECURITY VULNERABILITIES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.

22. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CHECK ON ME AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, SERVICE PROVIDERS, AND PARTNERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.

THIS INCLUDES, WITHOUT LIMITATION, DAMAGES RESULTING FROM:

  • MISSED CHECK-INS.
  • FAILED OR DELAYED NOTIFICATIONS.
  • FAILED SMS DELIVERY.
  • A DESIGNATED CONTACT FAILING TO RESPOND.
  • A USER FAILING TO RESPOND TO A CHECK-IN.
  • NETWORK OR INTERNET FAILURES.
  • DEVICE FAILURE.
  • THIRD-PARTY SERVICE FAILURE.
  • UNAUTHORIZED ACCESS.
  • LOSS OF DATA.
  • RELIANCE ON THE SERVICE DURING AN EMERGENCY.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE WILL BE LIMITED TO THE AMOUNT YOU PAID TO CHECK ON ME FOR THE SERVICE DURING THE PERIOD SPECIFIED BY APPLICABLE LAW, OR, IF YOU HAVE NOT PAID ANY AMOUNT, THE MINIMUM AMOUNT PERMITTED BY LAW.

NOTHING IN THESE TERMS IS INTENDED TO EXCLUDE OR LIMIT LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED.

23. Indemnification

To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Check On Me and its owners, officers, employees, contractors, affiliates, and service providers from claims, liabilities, damages, losses, costs, and expenses arising from:

  • Your violation of these Terms.
  • Your misuse of the Service.
  • Your violation of another person's rights.
  • Information you submit to the Service.
  • Your unauthorized use of another person's personal information.
  • Your violation of applicable laws or regulations.

24. Account Suspension and Termination

We may suspend or terminate your account if:

  • You violate these Terms.
  • You use the Service unlawfully.
  • You abuse or misuse the Service.
  • You compromise the security of the Service.
  • Your account creates a security or legal risk.
  • We are required to do so by law.
  • We discontinue the Service.

You may stop using Check On Me at any time.

Where available, you may request deletion of your account in accordance with our Privacy Policy.

Termination does not automatically eliminate obligations or rights that by their nature should survive termination.

25. Governing Law

These Terms will be governed by and interpreted in accordance with the laws applicable to the jurisdiction in which Check On Me is legally established, unless applicable law requires otherwise.

Any disputes arising from or relating to these Terms or the Service will be handled in accordance with applicable law and the appropriate courts or dispute-resolution procedures having jurisdiction.

26. Changes to These Terms

We may update these Terms from time to time.

When we make material changes, we may provide notice through the application, website, email, or another appropriate method.

The updated Terms will include a new Effective Date.

Your continued use of Check On Me after the updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.

27. Severability

If any provision of these Terms is determined to be invalid, illegal, or unenforceable, that provision will be interpreted or modified to the minimum extent necessary to make it enforceable.

The remaining provisions will continue in full force and effect.

28. Entire Agreement

These Terms, together with the Check On Me Privacy Policy and any additional terms presented to you for specific features or services, constitute the agreement between you and Check On Me regarding your use of the Service.

They supersede prior agreements or understandings regarding the same subject matter, except where otherwise stated.

29. No Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce that provision in the future.

31. Acknowledgment and Acceptance

BY CREATING AN ACCOUNT OR USING CHECK ON ME, YOU ACKNOWLEDGE THAT:

  • YOU HAVE READ AND UNDERSTAND THESE TERMS AND CONDITIONS.
  • YOU AGREE TO BE BOUND BY THESE TERMS.
  • YOU UNDERSTAND THAT CHECK ON ME IS NOT AN EMERGENCY RESPONSE SERVICE.
  • YOU UNDERSTAND THAT SMS, PUSH NOTIFICATIONS, INTERNET CONNECTIONS, DEVICES, AND THIRD-PARTY SERVICES MAY FAIL OR EXPERIENCE DELAYS.
  • YOU WILL NOT RELY ON CHECK ON ME AS THE SOLE MEANS OF PROTECTING YOURSELF OR ANOTHER PERSON DURING AN EMERGENCY.
  • YOU WILL CONTACT APPROPRIATE EMERGENCY SERVICES DIRECTLY WHEN AN IMMEDIATE OR LIFE-THREATENING EMERGENCY EXISTS.
  • YOU WILL PROVIDE ACCURATE INFORMATION AND USE THE SERVICE RESPONSIBLY.

If you do not agree with these Terms, please do not use the Check On Me Service.
